Melania Trump is back in the spotlight over how she obtained U.S. citizenship—through the elite EB-1 visa, often called the “Einstein visa.”
Reserved for individuals with “extraordinary ability,” the EB-1 is typically awarded to Nobel laureates, Oscar winners, and Olympic athletes.
A Washington Post investigation reignited public scrutiny, especially as her husband, Donald Trump, is known for tough immigration policies.
Critics question how Melania, then a Slovenian model, met such elite standards. Rep. Jasmine Crockett (D-TX) highlighted the disparity,
comparing Melania’s career to that of high-profile models like Tyra Banks, noting that Melania’s accomplishments may not justify the visa.
However, immigration lawyers say the EB-1 criteria allow flexibility. Attorney Susan McFadden explains that presentation and legal
strategy matter as much as accolades. If an applicant can meet three of ten criteria—such as media recognition or influential
endorsements—they may qualify. Lawyer Nita Upadhye adds that backing from powerful figures can significantly strengthen a case.
Melania became a U.S. citizen in 2006 and later sponsored her parents’ immigration. While questions remain, her case underscores how immigration
